Terms of Service
Last updated: August 17, 2026
These website Terms describe Seenwell's general service policies. A client project is governed by the proposal, statement of work, order form, or service agreement accepted for that project. If a signed client agreement conflicts with these website Terms, the signed client agreement controls to the extent of that conflict.
1. Services and Scope
Seenwell provides website design and development, website management, search engine optimization, AI visibility and answer engine optimization, content updates, and related digital services. The specific services, deliverables, exclusions, schedule, revision limits, and fees for a client project are stated in the applicable written proposal or service agreement.
Work requested outside the agreed scope may require a written change order, additional fee, or revised delivery schedule. Seenwell is not required to begin out-of-scope work until the client approves the additional scope and applicable charges.
2. Website Package Fees
Website package prices displayed on the Seenwell website are starting package prices and are subject to the final written scope. Unless otherwise stated in the signed agreement, project fees do not include third-party costs such as domain registration, paid software, premium plugins, stock photography, paid fonts, advertising spend, ecommerce transaction charges, or third-party platform fees.
Payment schedules and any deposits are stated in the applicable proposal or service agreement. Amounts already earned for completed work are non-refundable except where required by applicable law or expressly provided in the signed agreement.
3. Required Site Care
Website packages hosted and managed by Seenwell require Site Care after launch at the monthly rate disclosed with the selected website package and in the applicable agreement. The current standard Site Care rate is $99 per month.
Site Care includes routine security monitoring, platform or dependency maintenance when applicable, uptime checks, backups when supported by the hosting environment, and up to 30 minutes of routine minor content edits per monthly billing period. Unused edit time does not carry forward.
Minor edits generally include replacing existing text, swapping an existing image, updating contact information, or changing an existing link. Minor edits do not include new pages, redesigns, custom features, integrations, substantial copywriting, ecommerce configuration, or other development work. Such work may be quoted separately.
4. Monthly Growth Plans and Recurring Billing
Seenwell may offer monthly Care, Growth, and Visibility+ plans. Current advertised rates are $149, $299, and $499 per month. Site Care is included in each of these plans, so a client enrolled in a Growth plan is not separately charged the standard $99 Site Care fee for the same website during that billing period.
When a client affirmatively enrolls in a recurring service, the client authorizes Seenwell or its payment processor to charge the agreed recurring fee on the disclosed billing schedule until the service is canceled in accordance with the applicable service agreement. The billing frequency, renewal terms, cancellation procedure, and any required notice period will be disclosed before recurring billing is authorized.
Seenwell will not represent a one-time website fee as inclusive of recurring services when recurring charges also apply. Recurring charges are disclosed separately before purchase.
5. Cancellation
Unless a signed agreement states a different commitment or notice period, monthly recurring services continue on a month-to-month basis until canceled. Cancellation requests must follow the method stated in the applicable service agreement. Cancellation stops future recurring service after the effective cancellation date but does not reverse amounts already earned or properly charged for prior service periods, except where required by law.
6. Client Responsibilities
The client is responsible for providing timely access, approvals, business information, logos, photographs, service details, legal disclosures, and other materials reasonably needed to complete the project. The client represents that it has the right to use all materials it supplies to Seenwell.
The client is responsible for reviewing business claims, pricing, licensing statements, regulated-industry statements, privacy disclosures, and other factual or legal content before publication.
7. Intellectual Property
Ownership of custom deliverables is governed by the applicable client agreement. Unless otherwise stated in that agreement, rights in final custom website deliverables are transferred to the client after all applicable project fees have been paid in full.
Seenwell retains ownership of its pre-existing tools, workflows, reusable code, know-how, templates, systems, and general methods. Third-party software, libraries, fonts, stock assets, plugins, hosting services, and other third-party materials remain subject to their respective license terms.
8. SEO, AEO, and AI Visibility
Seenwell does not control Google, Bing, ChatGPT, Gemini, Perplexity, other search engines, AI systems, directories, advertising platforms, or third-party algorithms. Seenwell does not guarantee any specific ranking, indexing decision, AI citation, recommendation, traffic level, lead volume, sale, revenue increase, or other business result.
SEO, AEO, and AI visibility services are optimization efforts based on available information, technical best practices, content quality, and the client's business facts. Third-party platforms may change their systems at any time.
9. Security and Availability
Seenwell uses commercially reasonable practices within the scope of the purchased services, but no website, hosting provider, network, or software system can be guaranteed to be uninterrupted or completely secure. Site Care is a maintenance service and is not a warranty against hacking, outages, data loss, malware, third-party failures, or other security incidents.
10. Third-Party Services
Websites may rely on third-party products or services such as Cloudflare, domain registrars, analytics providers, form services, scheduling platforms, payment processors, email services, or other integrations. Seenwell is not responsible for the availability, pricing, policy changes, data practices, or independent acts of third-party providers.
11. Warranties
Except as expressly stated in a signed client agreement and to the maximum extent permitted by applicable law, services are provided without additional warranties, whether express, implied, or statutory. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
12. Limitation of Liability
Any limitation of liability applicable to a client engagement will be stated in the signed client agreement and will apply only to the extent permitted by applicable law. These website Terms are not intended to waive rights that cannot legally be waived.
13. Legal and Regulatory Review
Seenwell provides website and marketing services, not legal, tax, accounting, or regulatory advice. Clients operating in regulated industries or collecting personal information should obtain appropriate professional advice regarding their own legal obligations, privacy practices, accessibility requirements, advertising claims, and industry-specific disclosures.
14. Changes to These Terms
Seenwell may update these website Terms from time to time. Changes apply prospectively unless a signed client agreement provides otherwise. Material changes to an existing paid engagement remain subject to the terms of the applicable agreement.
15. Contact
Questions about these Terms or Seenwell services can be submitted through the project contact page.
